Conflicto de competencia suscitado entre el Juzgado Primero Promiscuo Municipal de Aguachica (Cesar) y el Juzgado Tercero Penal Municipal con Función de Control de Garantías de Ocaña (Norte de Santander).
La controversia se generó en torno a las diferentes interpretaciones que del factor territorial hicieron los despachos judiciales involucrados.
Teniendo en cuenta que ambas autoridades tienen competencia territorial para decidir la acción de tutela formulada, considera la Corte que debe respetarse la elección que hizo el demandante y disponer que quien debe hacerlo es el despacho del municipio de Aguachica.
Se ordena enviar el expediente a este juzgado para que de manera inmediata tramite y adopte la decisión de fondo a que haya lugar.

- Primero. Promiscuo Municipal de Aguachica-Cesar, para que, de manera inmediata tramite y adopte la decision de fondo a que haya lugar.
- Tercero. Por la Secretaria General de la Corporacion, COMUNICAR a la parte demandante y al Juzgado
